The first session, titled "๐๐ฐ๐ธ ๐ต๐ฐ ๐๐ข๐ฏ๐ฅ๐ญ๐ฆ ๐๐๐๐ด?: ๐๐ณ๐ช๐ฎ๐ช๐ฏ๐ข๐ญ ๐๐ณ๐ฐ๐ค๐ฆ๐ฅ๐ถ๐ณ๐ฆ ๐ช๐ฏ ๐๐ณ๐ข๐ค๐ต๐ช๐ค๐ฆ", was led by ๐ฃ๐๐ฏ๐น๐ถ๐ฐ ๐๐๐๐ผ๐ฟ๐ป๐ฒ๐ ๐๐ฏ๐ฑ๐๐น๐น๐ฎ๐ต ๐ . ๐๐ฑ๐ฟ๐ถ๐, a former member of the Clinic. It provided student volunteers with practical insights into post-arrest procedures, custodial investigation protocols, and the legal safeguards available to Persons Deprived of Liberty (PDLs).ย
The training emphasized the constitutional right of persons under investigation to remain silent and to have competent and independent counsel.ย It explored the statutory duties of arresting, detaining, and investigating officers under Republic Act No. 7438, including the duty to inform arrested and detained persons of their rights in a language known to and understood by them and to ensure their access to competent and independent counsel. Beyond these, the discussion detailed the procedures governing inquest proceedings, the legal limits of detention under Article 125 of the Revised Penal Code of the Philippines, and other post-conviction remedies under the Probation Law and the Good Conduct Time Allowance (GCTA) Law, among others.
Translating theory into practice, the student volunteers participated in immersive simulations and drafting exercises under the guidance of Atty. Edris and the Clinic Director, ๐๐๐๐. ๐๐ผ๐ฎ๐ป๐ฎ๐ต ๐ . ๐๐น๐ถ๐ป๐ผ๐ด-๐๐ถ๐๐ผ๐ฐ๐ผ๐ฟ. The exercises included an inquest proceeding scenario and then a simulated jail visitation, allowing the participants to apply their knowledge to practical concerns involving arrested and detained persons.
Through the simulations, the student volunteers learned to assess the circumstances of a case, identify the rights and immediate needs of PDLs, and recommend appropriate legal remedies under the supervision of authorized supervising lawyers. The training also strengthened the participantsโ readiness to assist in the Clinicโs legal aid and human rights initiatives, while reinforcing that legal assistance must be competent, ethical, compassionate, and tailored to each clientโs circumstances.
This activity commenced the Clinic's ๐๐๐๐๐ ๐๐ณ๐ฐ๐ซ๐ฆ๐ค๐ต: ๐๐ข๐จ-๐ข๐ต๐ช๐ฎ๐ข๐ฏ, ๐๐ข๐จ๐ฑ๐ข๐ฏ๐ข๐ญ๐ช๐ฑ๐ฐ๐ฅ, ๐ถ๐จ ๐๐ถ๐ด๐ต๐ช๐ด๐บ๐ข ๐ฑ๐ข๐ณ๐ข ๐ด๐ข ๐๐ข๐ต๐ข๐ธ๐ฉ๐ข๐ฏ, and forms part of the projectโs efforts to strengthen human rights initiatives and improve legal response mechanisms across Northern Mindanao.
